Bombay High Court ने National Textile Corporation (NTC) की Jam Manufacturing Mills में मौजूद 13 कमर्शियल किरायेदारों को तत्काल राहत दी है। कोर्ट ने उनकी बेदखली की कार्रवाई पर रोक लगा दी है। किरायेदारों को सितंबर 2012 से ₹10,000 प्रति माह का मुआवजा देना होगा। यह राहत तब तक प्रभावी रहेगी जब तक सुप्रीम कोर्ट इस कानूनी सवाल का हल नहीं निकाल लेता कि क्या पब्लिक प्रिमाइसेस एक्ट, 1971 राज्य के किराया संरक्षण कानूनों पर हावी होगा।

Justice M.M. Sathaye, on June 10, described this as an 'ad hoc' arrangement pending a final decision from the Supreme Court on a crucial legal point.

पब्लिक प्रिमाइसेस एक्ट पर कानूनीThe core of this long-standing dispute lies in the application of the Public Premises (Eviction of Unauthorised Occupants) Act, 1971. Tenants, under the banner of the Public Sector Tenant Action Committee, have been fighting eviction notices issued by estate officers since 2008. The Supreme Court's upcoming ruling is pivotal, as it will determine if the Public Premises Act can supersede the safeguards provided by state rent control laws. A verdict in favour of the Public Premises Act could empower various Public Sector Undertakings (PSUs) that own prime commercial real estate in Mumbai to more easily evict long-term occupants.

This payment is to be made retroactively from September 2012 and will continue until June 2026. The September 2012 start date was chosen to align with earlier Supreme Court directives for tenants in nearby properties. The National Textile Corporation's counsel had argued for payments to commence from July 2008, the date of the initial eviction notices, citing financial losses due to delays. However, the court settled on the 2012 date, maintaining the current status quo of the properties.

With further hearings scheduled for August 5, investors and stakeholders are closely watching the Supreme Court's proceedings. Investors in sectors with significant exposure to government-owned land should monitor the Supreme Court's final interpretation, as it could set a major legal precedent for how PSUs manage and monetise their commercial properties occupied by existing tenants.
