Delhi Schools Ko Mili Fee Hike Ki Azaadi!
Delhi High Court ka bada faisla aaya hai! Ab se private unaided schools academic year start hone par fees adjust kar sakte hain, bina pehle government se poochhe. Yeh decision kuch petitions ke baad aaya hai, jisme Delhi Public School, Vasant Kunj bhi tha. Court ne clear kiya hai ki Delhi School Education Act, 1973 ke Section 17(3) ke according, schools ko sirf proposed fee statements submit karne hain, Directorate of Education (DoE) se koi explicit sanction nahi lena.
Regulatory Role Ki Nayi Definition
Justice Anup Jairam Bhambhani ne kaha ki DoE ka main kaam regulatory hai, jiska matlab hai ki profiteering aur commercialization ko rokna. Court ne yeh bhi note kiya ki DoE ne pehle legal requirements ko ignore kiya tha, jiski wajah se fees badhane ke proposals ko galat tareeke se reject kiya gaya tha. Judiciary ne saaf kar diya ki school finances mein micromanage karna DoE ke scope se bahar hai.
Financial Independence Ko Boost
Private schools ka kehna tha ki DoE tab tak interfere na kare jab tak audits se profiteering prove na ho. Court ne is baat se agree kiya, aur kaha ki expansion ke liye reasonable surplus theek hai, aur yeh zaroori nahi ki profiteering ho. Sirf surplus hone se DoE ko full financial audit ke bina fee increase ko contest karne ka reason nahi milta.
Arrears Recovery Nahi Milegi
Jabki schools ko future fee adjustments ke liye autonomy mili hai, court ne unhein pichhle academic years ke arrears collect karne ka right deny kar diya hai. Iska reason parents par financial burden padne ki possibility thi. Is ruling ka matlab hai ki current fee structure April 2027 tak apply hoga, jisse retrospective fee collection nahi ho payegi.
Education Sector Par Asar
Is ruling se Delhi ke private institutions ko operational flexibility mil sakti hai. Lekin, arrears recovery deny karne se parents ko sudden financial demands se protection milegi. Future fee adjustments ko DoE tabhi scrutinize karegi jab profiteering ka doubt hoga, matlab burden of proof change ho gaya hai. Schools ko ab future-looking financial planning aur surplus management par focus karna hoga.
