Yeh ₹450 Crore ka chakkar kya hai?
So basically, DGAP (Director General of Anti-Profiteering) ne yeh demand nikala tha ek consumer complaint ke baad. Complaint yeh thi ki Tata Play ne GST lagne ke baad apne prices kam nahi kiye aur tax benefits consumers tak nahi pahunchaye. Lekin Tata Play ka kehna hai ki GST se pehle ke entertainment taxes bhi pure consumers ko pass on nahi kiye gaye the, isliye price adjustment mushkil tha.
Court Ne Kyun Roki Demand?
Ab Delhi High Court is puri calculation method ko hi sawal pooch rahi hai. Court ko lagta hai ki shayad yeh ₹450 crore ka figure kisi solid proof ke bajaye assumptions par based hai. Especially jab DTH services par GST rate 15% se badhkar 18% ho gaya tha, toh profits kaise calculate kiye gaye, yeh court ko samajh nahi aa raha.
Aage Kya Hoga?
Court ne company par koi zabardasti ka kadam uthane se bhi mana kiya hai. Agli hearing July 28 ko hai. Yeh mamla DTH industry ke liye bhi important hai kyunki competitors jaise Airtel Digital TV aur Dish TV India bhi aise hi challenges face karte hain. OTT platforms se competition ke beech yeh tax demands company ke cash flow ko affect kar sakti hain.
Is case ka final decision DTH sector mein future tax disputes ke liye ek naya precedent set kar sakta hai.
