Mistry ka argument hai ki Trust Deed jo ki December 7, 1923 ko bana tha, usmein saaf likha hai ki trustees Zoroastrian hone chahiye aur Bombay Presidency ya Navsari ke permanent resident hone chahiye. Mistry ka ilzaam hai ki Srinivasan aur Singh na toh Zoroastrian hain aur na hi woh specific areas ke resident hain, isliye woh legal disqualification mein aate hain. Iske chalte, unki trustee banne se pehle ki actions bhi invalid hain. Mistry ne ise "maladministration" aur Trust Deed ke principles ka "blatant violation" bataya hai.
