Karnataka High Court ne ek bohot important decision diya hai. BDA ne **2010** mein jo site Pallavi Ram ko di thi, woh ab cancel ho gayi hai. Court ka kehna hai ki yeh allotment political favouritism ki wajah se hui thi aur rules follow nahi kiye gaye.

Kya hua?

Karnataka High Court ne Bangalore Development Authority (BDA) dwara 2010 mein ki gayi site allotment ko cancel kar diya hai. Court ne saaf kaha ki yeh 'G' category site Pallavi Ram ko, jo former Lok Sabha MP DB Chandregowda ki beti hain, galat tarike se di gayi thi. Bench ne, jisme Justice DK Singh aur Justice TM Nadaf shamil the, yeh conclude kiya ki allotment mein political influence ka istemal hua hai aur kuch fraudulent tarike apnaye gaye.

Court ne yeh bhi emphasize kiya ki public servants aur elected representatives ko public interest mein kaam karna chahiye, na ki personal gain ke liye.

Rules ki Dhajjiyan

Court ka faisla BDA (Allotment of Sites) Rules, 1984 ke violation par based tha. Rule 5 aur Rule 10 ke mutabik, 'G' category sites ke liye jo eligibility criteria hain, unhe nazarandaaz kiya gaya tha. Generally, agar kisi ko pehle BDA se site mili ho ya woh Bengaluru mein property owner ho, toh woh eligible nahi hota. Yahan applicantPallavi Ram ineligible thi kyuki unke father ko pehle hi BDA site mili thi aur unki mother ke paas issi area mein property thi.

Governance par Focus

Yeh judgment public development sector ke liye ek alert hai ki institutional integrity aur transparency kitni important hai. Court ne public office holders ki ethical responsibilities par bhi baat ki, jo state-run development agencies par judicial oversight ka reminder hai. Jab discretionary power ko rules ke upar rakha jata hai, toh public trust kam hota hai. Judiciary ne clear message diya hai ki family connections ya status ka use public resources distribute karne mein nahi hona chahiye.

Public Institutions ke liye Kyun Aham Hai?

Yeh ruling is principle ko reinforce karti hai ki public assets ko clear statutes ke according manage karna chahiye, na ki personal ya political influence se. Court ne ek aisi allotment ko invalidate kiya hai jisme petitioner ki land bhi involve thi, jissey rule of law ko administrative discretion se upar rakha gaya. Yeh case public development authorities ke liye conduct ke standards set karta hai aur judiciary ka role highlight karta hai in bodies ko accountable rakhne mein.

Aage Kya Dekhna Hoga?

Is judgment ke baad, sabse important hai yeh dekhna ki BDA future mein apni administrative aur allotment processes ko kaise adjust karta hai taki eligibility rules ka strict adherence ho. Hum dekh sakte hain ki discretionary categories ke liye vetting process aur bhi rigorous ho jaye aur site allocations mein transparency badhe. Yeh case dusre regions ki public development authorities ko bhi conflict of interest ko handle karne mein influence kar sakta hai, kyunki judiciary ne saaf kar diya hai ki statutory provisions ka compliance mandatory hai.
