India mein shaadi ke kanoon par debate chhid gayi hai. Asal mudda ye hai ki kya shaadi ke baad bhi biwi/pati ka sexual consent zaroori hota hai? Hindu Marriage Act, 1955 sirf shaadi ke time consent dekhta hai, baaki personal autonomy ka gap chhod deta hai. Ab Courts bhi is par sawaal utha rahe hain aur naye reforms ki baat ho rahi hai.
Kya hua?
India mein shaadi aur consent ke kanoonon ko lekar kaafi charcha ho rahi hai. Hindu Marriage Act, 1955 ke hisaab se, shaadi ke waqt consent hona chahiye, bas. Lekin shaadi ke baad biwi ya pati sexual intimacy ke liye mana kar sakta hai ya nahi, is par koi clear rule nahi hai. Matlab, shaadi ke baad personal autonomy ko lekar ek bada legal gap hai.
Legal Gap?
Is Act ke Section 12 ke under, zabardasti ya fraud se hui shaadi ko cancel kiya ja sakta hai. Agar koi physical ya mental wajah se shaadi ko aage nahi badha sakta, toh bhi shaadi cancel ho sakti hai. Par, agar koi sirf consent nahi deta, toh usko legal grounds nahi milte. Courts bhi medical issues ya pehle hue fraud ke alawa jaldi se kuch nahi karte.
Courts aur Society ka Perspective
Gujarat High Court ne recently kaha hai ki shaadi ka matlab ye nahi ki hamesha ke liye sexual consent mil gayi. Yeh ek important observation hai jo dikhata hai ki judiciary bhi individual dignity aur bodily autonomy ko importance de rahi hai. Par, pehle Courts ne aise cases ko medical incapacity ya fraud ke grounds par dismiss kiya hai.
Society mein bhi kai jagah pressure hota hai ki shaadi nibhani padti hai. Is wajah se apni rights claim karna mushkil ho jaata hai. Kuch log keh rahe hain ki current laws shayad traditional soch ko hi promote kar rahe hain.
Aage kya?
Experts keh rahe hain ki laws ko modern banane ki zaroorat hai. Ek tareeka ye ho sakta hai ki shaadi mein consent na hone ko bhi cancel hone layak shaadi ka valid reason maana jaye. Ya phir 'cruelty' ya 'force' jaise terms ko expand kiya jaye taaki consent violation wale cases bhi isme aa sakein. Aim ye hai ki shaadi ko ek static contract se hatakar, ek aisi partnership banaya jaye jahan dono individuals ki consent ki value ho.
