Ab ye DPDP Act kehti hai ki agar koi company data protect karne mein fail hui, aur Data Protection Board un par koi fine lagati hai, toh woh paisa seedha India ke Consolidated Fund mein jayega. Matlab, sarkaar ki jeb bharegi, victim ko seedha kuch nahi.
Aur yeh fine bhi kamaal ke hote hain, ₹250 Crore tak ja sakte hain! Pehle IT Act ke Section 43A aur uske rules ke tahat, victim ko company ki negligence ke liye damages claim karne ka clear right tha. Woh pura system hi ab badal diya gaya hai.
Isse ek bada sawaal ye khada ho raha hai ki companies data security par itna focus kyun dengi agar unki galti ka bojh seedha victim par hi girne wala hai? Critics keh rahe hain ki isse accountability kam ho sakti hai.
Victims ke liye litigation ka rasta bhi ab aur mushkil ho gaya hai. Bina Section 43A ke clear support ke, court mein jaana aur justice paana bohat mehenga aur time-consuming ho sakta hai.
World mein dekho toh Europe ka GDPR victims ko damages ke liye right deta hai. India ka ye move usse kaafi different hai.
Business aur investors ke liye bhi ye important hai. Companies ko ab regulations follow karne par zyada dhyan dena hoga, kyunki direct financial hit kam ho sakta hai, lekin regulatory compliance budget badh jayega.
Toh overall, DPDP Act data governance ko strong bana raha hai aur penalties bhi badi hain, lekin victim ko direct compensation na milna ek chinta ka vishay hai.
