Court ne FSSAI ke Ashwagandha Leaf Ban par Lagaya Stay!
Karnataka High Court ne FSSAI (Food Safety and Standards Authority of India) ke us advisory ko temporarily suspend kar diya hai jisme Ashwagandha ke patton aur unke extracts ka istemaal food aur supplements mein restricted kiya gaya tha. Is decision se 8 companies ko immediate relief mili hai.
Companies ka kehna, 'Yeh Advisory Galat Hai!'
FSSAI ne 16 April ko yeh advisory jaari ki thi, jiske hisaab se sirf Ashwagandha ki jadon aur unke extracts ka istemaal allow hota. Pehle yeh practice nahi thi aur yeh Ministry of Ayush ke notification se judaa hua tha. Kerry Inc. aur uski subsidiary Sami-Sabinsa Group jaisi companies ka kehna hai ki aise restrictions sirf advisory se nahi lagaye ja sakte, iske liye Food Safety and Standards Act, 2006 mein formal changes hone chahiye. Kerry Group toh saalon se Ashwagandha ke patton ka istemaal kar rahi hai aur FSSAI ne pehle kabhi objection nahi kiya tha.
Companies ne yeh bhi kaha hai ki Ministry of Ayush ke notification mein koi scientific evidence nahi hai jo yeh bata sake ki Ashwagandha ke patte khane se koi safety issue ho sakta hai. Yeh case traditional medicine ko recognize karne aur strict food safety regulations ke beech ka conflict dikha raha hai.
Aage Kya Ho Sakta Hai?
FSSAI aur Ministry of Ayush agli hearing, jo ki June 8 ko hai, usmein is interim order ko overturn karne ki koshish kar sakte hain. Agar regulatory bodies safety risks ka strong scientific evidence pesh karte hain ya advisory ko legal batate hain, toh companies ko phir se restrictions face karne pad sakte hain. Lambi legal battles se operational uncertainty bhi ho sakti hai, jo investment aur product development ko affect kar sakti hai.
Jo companies is case mein nahi hain, unko temporarily fayda mil sakta hai. Yeh case nutraceutical industry mein regulatory changes kaise implement hote hain aur unhe support karne ke liye kitne evidence ki zaroorat hai, iska ek example set karega. Industry yeh dekhne ke liye excited hai ki agli hearing se future mein herbal ingredients ko lekar regulatory approach par kya asar padega.
