RIL Ki Appeal Order: Delhi High Court Ka Faisla, Government Ka Case Strong!
Overview

Arre yaar, Reliance Industries (RIL) ke liye Delhi High Court se ek badi khabar aayi hai. Court ne kaha hai ki government ki appeal jo RIL ke khilaaf Panna, Mukta, Tapti (PMT) gas fields wale case mein thi, woh maintainable hai. Matlab ab government ₹3.86 billion ke award ko enforce karne ke liye aage badh sakti hai.

Court Ne RIL Ki Objections Ko Thukraya!

Delhi High Court ke division bench ne RIL ki un baaton ko bilkul reject kar diya ki government ki appeal suni hi nahi ja sakti. Court ka kehna hai ki Arbitration & Conciliation Act, 1996 ke Section 50(1)(b) ke hisaab se, agar koi foreign award enforce karne se mana kiya jaata hai, toh uske khilaaf appeal file ki ja sakti hai. Isiliye, government jo 2016 ke Final Partial Award (FPA) ko enforce karna chahti hai, woh bilkul valid hai.

Case Ab Seedha Merits Par Jayega

Yeh ruling RIL ke liye ek set back hai kyunki unki preliminary objections ko maana nahi gaya. Ab yeh case 17th February ko seedha merits par discuss hoga. Court ne RIL aur uske partners par public funds ₹5 billion se zyada galat tarike se rokne ka allegation bhi dekha hai. Yeh pura mamla 2010 mein shuru hue arbitration se juda hai, jismein cost recovery, royalties aur taxes ko lekar disputes hain.

PMT Fields Ka Lamba Case

PMT fields ka yeh arbitration 2010 se chal raha hai. 2016 ke award mein mostly government ki baat maani gayi thi ki profit calculation 33% tax rate deduct karne ke baad honi chahiye. Lekin RIL aur unke partners ne cost recovery limits badhane ki koshish ki. Government ₹3.86 billion recover karne ki koshish mein hai. Isse pehle RIL ne English courts mein bhi alag-alag disputes jeete hain, jaise ki KG-D6 basin mein gas migration claims ka ek mamla.
