Court ne is baat par Gujarat High Court ke pehle ke rulings ka sahara liya, jisme aise hi sugar exporters ko RoDTEP benefits mile the. Union government ki appeals ko Supreme Court ne bhi dismiss kar diya tha. Isse government ka inconsistent approach saaf dikh raha tha, isliye ek unified policy ki zaroorat hai.
RoDTEP scheme asal mein exporters ke liye hai taaki unhein export par lage embedded indirect taxes aur duties wapas mil sakein, jisse unki global competitiveness badhe. Yeh pehle wali MEIS scheme ko replace karke aaya hai taaki WTO rules follow hon.
Court ki ye demand business ke liye bahut important hai kyunki ye jo legal uncertainty aur conflicting government stands hain, woh paisa aur samay dono barbaad karte hain. Businesses ko planning karne mein mushkil hoti hai. Especially agriculture jaise sectors mein, jahan already global price swings kaafi hote hain.
Agar national litigation policy nahi bani toh ye confusion chalta rahega. Government ki alag alag directives se businesses ko long legal battles aur delay ka saamna karna pad sakta hai. RoDTEP jaise schemes mein already documentation aur understanding ko lekar issues hain, jo inconsistent government actions se aur badh sakte hain.
Bombay High Court ki ye strict recommendation ek bada step hai ek formal national litigation policy ki taraf. Isse government legal cases mein responsible banegi, court ka load kam hoga, aur businesses ko clarity milegi. Ab dekhte hain ki government is par kitna jaldi action leti hai.
