Court ne maangi AT-1 Bond decision ki documents
Supreme Court, Finance Ministry dwara Rs 8,415 crore ke Yes Bank AT-1 bond write-off ko handle karne ke tareeke ki jaanch tez kar raha hai. Justice Dipankar Datta ne Solicitor General Tushar Mehta ko 2023 ke decision ke saare supporting documents, Cabinet resolution, aur meeting minutes submit karne ka aadesh diya hai.
Cabinet Meeting Procedures ki jaanch
Mehta ko usi din 3 PM tak Cabinet decision minutes pesh karne honge. Court ne Cabinet meeting rules, quorum details, aur uss crucial decision ke time par present members ke naam bhi maange hain. Justice Datta ne stress kiya ki court ko Cabinet meeting ki validity par santosh hona chahiye aur Mehta ko unki client ko savdhani se salah dene ki warning di, agar court santosh nahi hua toh woh apna nirdesh jari kar sakte hain.
Bombay High Court ruling ko challenge
Yeh Supreme Court proceedings Yes Bank, Reserve Bank of India (RBI), aur Finance Ministry ki appeal se hui hain. Woh January 2023 ke Bombay High Court ke ek order ko challenge kar rahe hain. High Court ne pehle RBI aur Yes Bank ke AT-1 bonds ko write-off karne ke decision ko palat diya tha. Ye bonds, jinki value Rs 8,415 crore thi, alag alag investors ke paas the, jinme mutual funds, financial institutions, aur retail investors shaamil hain. Kai bondholders, khaas kar retail investors, ne write-off ke baad High Court se redressal maanga tha, jise court ne pehle maan liya tha.
