Reserve Bank of India (RBI) ne mobile phone loan ko lekar ek important announcement kiya hai. Ab se, agar kisi ne phone finance karwaya hai aur payment late ho gayi, toh banks ya lenders us phone ko completely disable nahi kar sakte.

Haan, lenders kuch functions ko restrict zaroor kar sakte hain taaki unka paisa wapas aa sake, lekin phone ko poora useless banana ab allowed nahi hoga. Isse consumers ko relief milegi kyuki unka communication ka zariya band nahi hoga.

Loan Recovery Ke Naye Niyam Aur Borrower Ke Rights

Yeh naye rules October 1, 2026 se लागू ho jayenge. RBI ka kehna hai ki lenders ko recovery ke liye step-by-step approach follow karna hoga. Kisi bhi device feature ko restrict karne se pehle, loan agar 90 days late hai aur lender ne multiple reminders bhi bhej diye hon tabhi yeh step liya ja sakta hai.

Jab loan 60 days late hoga, tab pehla notice bheja jayega, jisme borrower ko issue solve karne ke liye 21 days ka time milega. Agar phir bhi baat nahi banti, toh ek aur notice aayega jisme 7 din ka extra time diya jayega.

Sabse important baat, internet access, incoming calls, emergency services, aur zaroori government notifications jaise crucial features ko disable nahi kiya ja sakta. Agar lender ne koi restriction lagayi hai, toh borrower ke payment karte hi 1 ghante ke andar usse hataana padega. Aur agar lender ne galati se phone restrict kiya ya restriction hatane mein der ki, toh unhe per hour ₹250 ka compensation borrower ko dena hoga. Lender borrower ke phone ka data bhi access ya use nahi kar sakte recovery ke liye. Loan agreement mein yeh sab terms clearly likhe hone chahiye.

Loan Recovery Practices Mein Bade Sudhar

Yeh guidelines loan recovery ke tareekon mein badlav ka hissa hain. RBI recovery agents ke liye bhi strict conduct rules bana raha hai, jisme mandatory certification, kaam karne ka time (subah 8 baje se shaam 7 baje tak) aur dhamki, harassment ya public shaming par poori rok lagayi gayi hai. Banks ko recovery calls record karni hongi aur unhe kam se kam 6 mahine tak save karna hoga. Customer complaints ko solve karne ke baad hi recovery cases agencies ko diye jayenge.

RBI ne data privacy ko bhi mazbooti di hai, lenders ko kisi bhi time borrower ke phone par data access karne se mana kiya gaya hai. India mein, 1/3rd se zyada consumer electronics, jaise smartphones, chote loans par hi kharide jaate hain. September 2025 tak, consumer durables ke liye outstanding loans ₹22,279 crore the. Yeh naye rules lenders ko recovery ke options toh dete hain, par saath hi borrower ke rights aur privacy ko bhi protect karte hain.
