Dekho, National Company Law Appellate Tribunal (NCLAT) ne Lyka Labs ki insolvency ki plea phir se shuru kar di hai Modi Lifecare Industries ke khilaaf. Ab Modi Lifecare ko Rs 63 lakh ki royalty deni hogi. Yeh NCLAT ka faisla NCLT ke pehle wale decision ko palat deta hai aur Modi Lifecare par pressure aa gaya hai.
Yeh paison ka mamla ek technical guidance agreement se shuru hua tha jo 2012 mein hua tha. Isme product labels aur cartons ke liye royalty dena tha. Lyka Labs ka kehna hai ki Modi Lifecare ne yeh dues maanne the aur bola tha ki yeh sales par depend nahi karta. Modi Lifecare ne ek purane dispute ka hawala diya tha, lekin NCLAT ne usko reject kar diya. Tribunal ne kaha ki company ke beech hui baatcheet se pata chalta hai ki unhone yeh accept kiya tha, aur formal invoices na hone se Lyka Labs ka claim cancel nahi ho jata.
Ab Modi Lifecare Industries ke paas sirf 30 din hai Lyka Labs ko Rs 63 lakh dene ke liye. Agar aisa nahi hua toh NCLT Ahmedabad-based pharma company ke khilaaf insolvency proceedings shuru kar degi. Lyka Labs ke liye yeh badi jeet hai, kyunki NCLT ne pehle unki plea dismiss kar di thi. NCLAT ke yeh findings Modi Lifecare ki legal position ko kamzor karti hain aur unki financial problem ko bhi dikhati hain, khaas kar jab Dr. Reddy's Laboratories aur Sun Pharmaceutical Industries jaise bade players ko dekha jaaye.
Modi Lifecare ka future ab is baat par depend karta hai ki woh yeh payment deadline poori kar paate hain ya nahi.
