नेशनल कंपनी लॉ अपीलेट ट्रिब्यूनल (NCLAT) ने भारतीय प्रतिस्पर्धा आयोग (CCI) के उस निर्देश को आंशिक रूप से रद्द कर दिया है, जिसने व्हाट्सएप को विज्ञापन उद्देश्यों के लिए अपनी मूल कंपनी, मेटा के साथ उपयोगकर्ता डेटा साझा करने से मना किया था। ट्रिब्यूनल ने मेटा द्वारा ओवर-द-टॉप (OTT) मैसेजिंग ऐप बाजार में अपनी प्रमुख स्थिति के दुरुपयोग के निष्कर्ष को भी पलट दिया। हालांकि, NCLAT ने मेटा पर CCI द्वारा पहले लगाए गए ₹213.14 करोड़ के जुर्माने को बरकरार रखा है। CCI का मूल आदेश, जो नवंबर 2024 में जारी किया गया था, ने मेटा पर इसलिए जुर्माना लगाया था क्योंकि व्हाट्सएप की 2021 की गोपनीयता नीति अपडेट, जो डेटा साझाकरण को \"लो या छोड़ दो\" (take-it-or-leave-it) आधार पर अनिवार्य करती थी, उसे प्रमुखता के दुरुपयोग के रूप में माना गया था। CCI ने व्हाट्सएप को पांच साल तक मेटा सहयोगियों के साथ उपयोगकर्ता डेटा साझा करने से रोकने और सेवा पहुंच के लिए डेटा साझाकरण को पूर्व शर्त बनाने से रोकने का निर्देश दिया था। व्हाट्सएप और मेटा ने इस आदेश को चुनौती दी थी, और NCLAT ने पहले ही जुर्माने और डेटा साझाकरण पर रोक लगा दी थी। ट्रिब्यूनल ने कहा कि इस पर रोक लगाने से व्हाट्सएप के बिजनेस मॉडल को नुकसान हो सकता है।
