નેશનલ કંપની લો એપેલેટ ટ્રિબ્યુનલ (NCLAT) એ ભારતીય સ્પર્ધા આયોગ (CCI) ના તે નિર્દેશને આંશિક રીતે રદ કર્યો છે, જેણે WhatsApp ને જાહેરાત હેતુઓ માટે તેની પેરન્ટ કંપની Meta સાથે વપરાશકર્તા ડેટા શેર કરવા પર પ્રતિબંધ મૂક્યો હતો. ટ્રિબ્યુનલે ઓવર-ધ-ટોપ (OTT) મેસેજિંગ એપ માર્કેટમાં Meta દ્વારા તેની પ્રબળ સ્થિતિનો દુરુપયોગ કરવાના CCI ના તારણને પણ ઉલટાવી દીધું છે. જોકે, NCLAT એ Meta પર CCI દ્વારા અગાઉ લાદવામાં આવેલ ₹213.14 કરોડનો દંડ યથાવત રાખ્યો છે. CCI નો મૂળ આદેશ, જે નવેમ્બર 2024 માં જારી કરવામાં આવ્યો હતો, તેણે Meta ને દંડ ફટકાર્યો હતો કારણ કે WhatsApp ની 2021 ની પ્રાઇવેસી પોલિસી અપડેટ, જે ડેટા શેરિંગને \"લેવો અથવા છોડો\" (take-it-or-leave-it) ધોરણે ફરજિયાત બનાવતી હતી, તેને દુરુપયોગ તરીકે ગણવામાં આવ્યો હતો. CCI એ WhatsApp ને પાંચ વર્ષ સુધી Meta સાથે વપરાશકર્તા ડેટા શેર કરવા પર પ્રતિબંધ મૂકવા અને સેવા ઍક્સેસ માટે ડેટા શેરિંગને પૂર્વશરત બનાવવા પર રોક લગાવવાનો નિર્દેશ આપ્યો હતો. WhatsApp અને Meta એ આ આદેશને પડકાર્યો હતો, અને NCLAT એ અગાઉ દંડ અને ડેટા શેરિંગ પ્રતિબંધ પર સ્ટે મૂક્યો હતો. ટ્રિબ્યુનલે નોંધ્યું કે પ્રતિબંધ WhatsApp ના બિઝનેસ મોડેલને નુકસાન પહોંચાડી શકે છે.
અસર: NCLAT નો આ નિર્ણય Meta માટે રાહત લઈને આવે છે કારણ કે ડેટા શેરિંગ પ્રતિબંધ અને જાહેરાતો માટે પ્રબળ સ્થિતિના દુરુપયોગની શોધ દૂર કરવામાં આવી છે, જે ડિજિટલ ક્ષેત્રમાં સ્પર્ધા નિયમો પ્રત્યે વધુ સૂક્ષ્મ દૃષ્ટિકોણ દર્શાવે છે. જોકે, યથાવત રાખવામાં આવેલો દંડ અમુક પ્રથાઓ માટે સતત નિયમનકારી તપાસ અને નાણાકીય દંડ સૂચવે છે. આ નિર્ણય ભારતમાં ડેટા નીતિઓ અને સ્પર્ધા અંગે અન્ય ટેક જાયન્ટ્સના અભિગમને પણ પ્રભાવિત કરી શકે છે. રેટિંગ: 6/10.
