The Department of Telecommunications (DoT) is planning to seek legal counsel to understand the full implications of the Supreme Court's latest order concerning Vodafone Idea's Adjusted Gross Revenue (AGR) dues. The apex court's ruling, delivered by Chief Justice B R Gavai and Justice K Vinod Chandran, stated that the government is not restrained from reconsidering the issue in the public interest. However, the court explicitly confined its order to Vodafone Idea's plea regarding a specific additional demand of Rs 9,449.23 crore, related to dues up to fiscal year 2016-17.
This nuanced judgment has created uncertainty. On one hand, it upholds the government's authority to act based on economic and public considerations, such as its 49% equity stake in Vodafone Idea and the interests of its 200 million subscribers. On the other hand, it limits the scope for reassessing the company's overall AGR liabilities, which were previously determined by a 2020 judgment to be over Rs 58,000 crore, escalating to approximately Rs 83,400 crore with interest and penalties. Vodafone Idea had challenged the recent demand, arguing it violated the finality of earlier court decisions.
