India is set to implement a significant reform in its labour laws with the Code on Wages, 2019, which introduces a statutory floor minimum wage. This move aims to address historical inconsistencies, subjective fixation, and political distortions that have plagued minimum wage regulation since the Minimum Wages Act, 1948.

Historical Challenges in Wage Fixation

  • For decades, minimum wage rates in India have been inconsistent, often influenced by political considerations rather than objective criteria.
  • State governments frequently set wages below practical subsistence levels, sometimes even below Central government standards for the same region.
  • This led to disparities, where workers in Central establishments like Indian Railways earned more than similarly skilled workers in state-regulated private sectors.

Evolution of Wage Standards

  • Recommendations from the Indian Labour Conference in 1957 proposed five considerations for wage fixation, including food, clothing, housing, and miscellaneous needs for a standard family.
  • The Supreme Court, in the Reptakos Brett case (1992), expanded this concept to include social dignity components like education, medical needs, and old-age provisions, quantifying this at 25% above the core subsistence basket.
  • The Tripartite Committee on Fair Wages (1948) defined a three-tier structure: minimum wage (subsistence and efficiency), fair wage (capacity to pay, productivity), and living wage (dignified life).

Attempts at a National Baseline

  • The National Commission on Rural Labour (NCRL) recommended a single basic national minimum wage to ensure no employment fell below a certain level, leading to the National Floor Level Minimum Wage (NFLMW) in 1996.
  • However, the NFLMW lacked statutory force, allowing states to fix wages below it, as noted by the Anoop Satpathy Committee in 2019.

The Code on Wages, 2019: A New Era

  • The Code on Wages, 2019, rectifies this by empowering the Central government to notify a statutory floor wage based on geographic zones.
  • Once implemented, no state government can set its minimum wage below this statutory floor.
