Massachusetts Imposes Clean Energy Rules on Large Data Centers

Massachusetts has issued Executive Order 658 requiring new data centers exceeding 25 megawatts to source clean energy or pay into a protection fund. This mandate, combined with a previous freeze on tax incentives, increases regulatory compliance costs and may delay project timelines for large-scale computing facilities in the state.

Massachusetts has officially updated its regulatory framework for data centers, introducing stricter requirements for large-scale energy infrastructure. Through Executive Order 658, signed by Governor Maura Healey, the state now requires all new data center projects with a peak electricity demand exceeding 25 megawatts to adhere to new clean energy and transparency standards.

Under this mandate, developers must ensure that their projects are powered by independent clean energy sources. If operators cannot generate or procure sufficient clean power onsite, they are required to contribute to a newly established Ratepayer Protection Fund. This measure aims to balance the rapid expansion of energy-intensive data infrastructure with the state's broader goals for electricity affordability and grid reliability.

These requirements follow an earlier administrative decision in June 2026, which paused applications for state-level data center sales and use tax exemptions. By linking project approvals to clean energy compliance and formal community benefit agreements, the state has effectively increased the regulatory hurdle for new entrants. The order also restricts the use of non-disclosure agreements between state agencies and developers, signaling a push for greater transparency in how large infrastructure projects are vetted and approved.

For investors, these policy changes suggest a shift in the operating environment for tech and infrastructure companies planning expansions in the region. The requirement to secure local community approval and invest in clean power or state funds can increase capital spending and may lead to longer permitting timelines compared to previous years. These factors are important to track, as higher development costs or unexpected delays can impact the expected return on investment for large-scale data center projects.

This move by Massachusetts reflects a broader national trend where state governments are re-evaluating the impact of data centers on local power grids, especially as demand from artificial intelligence and cloud computing continues to rise.
