India's Ministry of Electronics and Information Technology (MeitY) is planning to amend the Information Technology Rules, 2021, to introduce mandatory labeling for AI-generated or synthesized content. Under the proposed rules, digital platforms must clearly identify content that has been created or modified by artificial intelligence and appears authentic. This measure is intended to combat the spread of misinformation, hoaxes, and reputational damage caused by advanced AI technologies like deepfakes.
Platforms, including large social media intermediaries such as YouTube and Meta, as well as Indian startups like Invideo, will be responsible for implementing these labeling requirements. The proposed guidelines suggest that the AI-generated nature of content should be prominently marked, potentially covering at least 10% of the visual area or initial audio. Companies have a deadline of November 6 to review these proposed changes and submit their feedback. Critics, like the Internet Freedom Foundation (IFF), have raised concerns that the broad definition of 'synthetically generated information' could inadvertently affect creative content, satire, and harmless filters, potentially leading to over-censorship and stifling user creativity. They also point out that such mandates can be technically difficult to enforce accurately and may be evaded by malicious actors.
The government's move aligns with global trends, drawing inspiration from regulations in the European Union and California. It also comes in the wake of high-profile cases involving deepfakes, where courts have issued injunctions to protect individuals' personality rights.
