The Competition Commission of India (CCI) has requested clarification from the National Company Law Appellate Tribunal (NCLAT) regarding its judgment on WhatsApp's data sharing practices with Meta Platforms. The CCI seeks to ascertain if user consent is mandatory for data usage for advertising versus non-advertising purposes. This request follows NCLAT's partial relief to WhatsApp, which overturned a data-sharing ban for advertising but upheld a INR 213 Cr penalty and confirmed the privacy policy update breached antitrust laws.
