Supertech Homebuyers Move SC Against NBCC-Managed Projects

Homebuyers have approached the Supreme Court alleging zero progress on 17 stalled Supertech projects. The plea highlights concerns over Rs 30 crore in administrative costs and the delay in deploying a promised Rs 100 crore seed fund by project consultant NBCC. Investors should track the legal outcome on November 16, as delays in stressed project execution can impact brand reputation and operational timelines.

Homebuyers have filed a petition in the Supreme Court regarding 17 stalled residential projects under the Supertech banner. The core of the complaint focuses on the lack of construction progress, with residents alleging that the projects remain largely untouched despite assurances. The association representing the homebuyers contends that approximately Rs 30 crore has been spent on administrative and consultancy fees, yet no housing units have been completed or show significant on-site progress.

The situation involves NBCC (India) Limited, which was appointed as the Project Management Consultant. A key point of contention for the buyers is the alleged failure to deploy a committed Rs 100 crore seed fund, which was intended to restart construction activities. Furthermore, the association is challenging the company's request for exemptions from Real Estate Regulatory Authority (RERA) norms. The buyers argue that the project manager must comply with existing regulatory standards to ensure accountability, and they have requested that the firm be replaced if it cannot meet these requirements.

From an investor perspective, this dispute highlights the risks associated with the turnaround of distressed real estate assets. NBCC’s business model frequently includes taking over stalled projects to complete them, but legal and financial hurdles can lead to significant delays. When project management consultants face legal challenges or public criticism regarding execution and funding, it may impact the company's operational reputation and influence the progress of other projects in its portfolio.

The Supreme Court has asked all stakeholders to submit a viable proposal to address the ongoing gridlock. A primary suggestion being discussed is the formation of a One-Man Committee, potentially led by a former judge or an industry expert, to oversee the 17 projects under direct judicial supervision. The proposal also includes the implementation of an escrow account to manage all future capital flows, which would aim to provide greater transparency and financial accountability. The court has renotified the matter for a hearing on November 16, 2026. Investors and stakeholders will be watching the upcoming court decision, as the resolution of these management and funding issues will determine the timeline for the delivery of the 14,999 pending units.
