Judicial Decentralization Drive Intensifies
The Karnataka government's effort to establish a circuit Bench of the High Court in Mangaluru is meeting significant pushback.
Chief Minister Siddaramaiah has officially supported the proposal to Chief Justice Vibhu Bakhru, aiming to give coastal populations better judicial access. This move is intended to ease the travel and cost burdens for litigants and lawyers heading to the main High Court in Bengaluru. The suggested location in Mangaluru is the former Deputy Commissioner's office, which has ample space.
Regional Aspirations Clash with Centralized Concerns
The proposed Mangaluru Bench aims to improve justice delivery for Karnataka's coastal districts, an economically vital region. Supporters believe a local bench would make legal help more accessible and affordable.
However, the Advocates Association Bengaluru (AAB) has formally objected. They submitted a memorandum calling for a thorough study before any decision. The AAB is concerned that creating a circuit bench without solid data and broad consultation could weaken the High Court's standing and effectiveness.
Divergent Interests Fueling the Debate
Adding another layer to the discussion, a different group has proposed a High Court circuit Bench in Shivamogga. This indicates a growing demand across Karnataka for more decentralized judicial services.
This competing interest suggests that various regional centers might seek judicial resources, complicating the government's decision. The Advocates Association's warning about potential opposition from legal professionals highlights the delicate nature of this initiative. It underscores the need for a balanced approach that considers the impact on the state's entire judicial system. The debate now tests the state's ability to balance regional access with the integrity of its highest court.
