Courts Should Not Manage Infrastructure Projects
The Supreme Court clarified that the judiciary's role is not to manage infrastructure projects, such as laying sewer lines, but rather to ensure administrative bodies fulfill their duties. Justices Sanjay Kumar and K Vinod Chandran stated that government authorities are responsible for addressing public infrastructure problems.
Delhi High Court Order Overturned
The Supreme Court overturned an interim order from June 18, 2025, issued by the Delhi High Court. The High Court had directed the Delhi Jal Board (DJB), Municipal Corporation of Delhi (MCD), and All India Institute of Medical Sciences (AIIMS) to resolve sewer line installation issues for residents in Green Park Extension and nearby areas. The Supreme Court had previously put this order on hold on October 27, 2025.
Responsibility for Solutions
While acknowledging the inadequate drainage systems in the affected area, which cause severe waterlogging due to a growing population, the Supreme Court emphasized that the responsible authorities must develop practical solutions. The court noted that these solutions require input from all parties involved and must be implemented by the relevant government bodies.
Authorities Tasked with Action
The Supreme Court instructed the relevant authorities, including the Government of NCT of Delhi, DJB, MCD, and Delhi Metro Rail Corporation Limited, to thoroughly review the matter. They are required to report their proposed solutions to the High Court within a reasonable timeframe. This directive is particularly critical with the approaching monsoon season, which could worsen waterlogging and public health risks.
