SC Mandates Dedicated Facilities for Women Advocates in Courts

The Supreme Court has ordered all state governments and union territories to provide dedicated bar rooms and sanitation facilities for women advocates in district courts. The court rejected arguments regarding land or funding constraints, emphasizing that these amenities are essential for workplace equity. States are required to ensure compliance, with the next review scheduled for December 2, 2026.

The Supreme Court of India has issued a directive requiring all state governments and union territories to ensure the presence of basic amenities for women legal professionals in district and taluk courts. A bench led by Chief Justice of India Surya Kant, along with Justices Joymalya Bagchi and V Mohana, stated that the current lack of these facilities is unacceptable. The court's order aims to improve workplace standards and ensure professional equity for women in the legal sector.

The mandate specifies that dedicated bar rooms and sanitation facilities must be constructed, regardless of the number of women advocates currently practicing in a specific jurisdiction. The court clarified that these are essential requirements for advocates to perform their duties effectively, moving the issue from one of convenience to a fundamental professional necessity.

During the proceedings, the bench dismissed potential logistical concerns raised regarding land availability or budgetary limitations. The court has made it clear that administrative hurdles should not prevent the creation of a safe and inclusive environment. Consequently, high courts and state administrations are now tasked with securing the necessary land and funds to complete these infrastructure projects.

This ruling follows a broader push to improve inclusivity and infrastructure across the judiciary. The matter will be reviewed again on December 2, 2026, to monitor the progress of compliance across the country. The next important update will be the progress reports submitted by state governments regarding these construction projects.
