The NCLAT has reprimanded NBCC for missing deadlines to revive 16 stalled Supertech housing projects, ordering the urgent appointment of an interim resolution professional within seven days. The tribunal's move addresses failures to meet July 2026 targets and seeks to resolve coordination bottlenecks with the former developer's management.

The National Company Law Appellate Tribunal has expressed dissatisfaction with the progress of 16 stalled Supertech housing projects currently being managed by state-run NBCC. In a recent hearing, the tribunal highlighted that NBCC failed to meet several critical compliance and operational deadlines that were originally set for July 31, 2026. These missed targets include delays in securing necessary statutory permissions, completing project due diligence, and formally awarding construction contracts.

To address these hurdles, the tribunal has ordered the urgent appointment of an interim resolution professional within the next seven days. This professional will be responsible for chairing the Apex Court Committee and overseeing the various project-wise committees tasked with site management. The appointment is a key step in the ongoing Corporate Insolvency Resolution Process initiated by Union Bank of India.

Legal representatives for the project committees noted that the primary challenge lies in data coordination. They reported that former Supertech management has not yet handed over essential documentation, which prevents NBCC from finalizing project schedules and starting on-ground work. The tribunal has now directed that a comprehensive inventory of missing files be shared with the previous management to clear this deadlock before the next hearing scheduled for September 25, 2026.

For investors, the situation highlights the operational challenges inherent in taking over distressed real estate assets. While NBCC acts as a project management consultant in such cases, its ability to execute projects is often tied to external factors, including legal stability, data availability, and the cooperation of previous management. When these elements are delayed, it can extend the timeline for fee recognition and complicate the company’s focus on its core civil engineering and construction business. NBCC is expected to meet on September 20, 2026, to work on finalizing revised construction schedules.
