Justice M Nagaprasanna, presiding over the matter, sharply criticized the actions taken by the investigating officer. The court observed that the lawyer’s name was added to the remand application primarily to gain access to CCTV footage from the advocate’s office and residence, which are adjacent to the scene of the alleged crime. The bench described this method as a gross abuse of the legal process and questioned the motive behind implicating a legal professional for merely performing their duty of representing a client.

During the proceedings, the court highlighted the broader implications of such investigative practices. The bench noted that if individuals can be named in criminal cases solely to facilitate evidence collection, such as obtaining camera recordings, it could pose a risk to the safety and professional integrity of any citizen. The court has requested the State Public Prosecutor to provide specific instructions from the investigating officer regarding these actions. There is also a possibility of a departmental inquiry against the official if it is determined that the lawyer was implicated without substantial grounds.
