The government has clarified that AI data centers do not require special environmental clearance unless they exceed specific construction size thresholds. While this provides regulatory clarity for developers, investors should remain cautious about operational risks, including high water and power demand, which remain subject to local scrutiny and environmental laws.
The Union government has clarified in the Rajya Sabha that artificial intelligence (AI) data centers are not subject to a standalone, industry-specific environmental clearance process. Instead, these facilities are treated like other commercial or industrial buildings under the existing Environmental Impact Assessment (EIA) Notification of 2006. This means that environmental clearance is only mandatory if the project’s physical size exceeds defined thresholds, such as a built-up area of 20,000 square meters or more.
For investors and companies involved in the digital infrastructure sector, this distinction is important. It clarifies that the government is focusing on the 'construction footprint' of the project rather than the computing capacity or AI-specific operational model. If a data center developer keeps the built-up area below the specified limits, it may avoid the lengthy, large-scale environmental appraisal process typically required for major township or infrastructure projects. However, staying below these thresholds does not exempt projects from all regulations. Developers must still adhere to the Water (Prevention and Control of Pollution) Act, 1974, and the Air (Prevention and Control of Pollution) Act, 1981.
While this regulatory clarity may help expedite project timelines for some operators, it does not remove the operational risks associated with resource consumption. Data centers are notoriously intensive users of electricity and water, particularly for cooling purposes. Even if a project is legally compliant under construction norms, it remains susceptible to local operational challenges. For instance, in water-stressed regions, local authorities and communities are increasingly scrutinizing projects that compete with municipal water supplies.
The ongoing situation surrounding a major proposed AI data center in Visakhapatnam illustrates this risk clearly. Despite compliance with broader industrial regulations, the project has faced public opposition and legal hurdles due to concerns over local water availability. For investors, this highlights that legal compliance with construction-related environmental norms is only one part of the equation. 'Social license'—the acceptance of a project by the local community—is becoming a critical factor for the long-term viability of large digital infrastructure projects.
Moving forward, investors should monitor how individual states handle the integration of these centers. The Ministry of Jal Shakti’s 2023 guidelines on groundwater extraction and the Bureau of Energy Efficiency’s guidelines on cooling systems are increasingly relevant. Companies that invest in water-efficient cooling technology or secure reliable, non-competitive sources of power and water are likely to face lower regulatory and social resistance. The next key monitorable for the sector will be whether state-level authorities introduce more stringent, localized norms that go beyond the current national guidelines, potentially increasing operational costs or project timelines for developers.
