The U.S. Senate has initiated a procedural step to advance the Digital Asset Market Clarity Act, which seeks to establish federal rules for cryptocurrencies. The proposed law aims to classify digital tokens and define regulator jurisdiction. However, the bill faces hurdles in gathering the 60 votes required for passage, with significant opposition regarding stablecoin regulations and ethics provisions.

The U.S. Senate has taken a new step toward potentially regulating the digital asset industry. Majority Leader John Thune filed a procedural motion on August 8, 2026, to move the Digital Asset Market Clarity Act forward. The Senate is expected to hold a vote on the legislation when it reconvenes in mid-September.

Defining Assets and Jurisdiction

The core goal of this legislation is to provide a federal rulebook for the crypto industry, which has operated with limited clear guidelines. The bill aims to classify digital tokens as either securities or commodities. This distinction is vital because it determines which government agency has oversight authority.
