Supreme Court Seeks Report on Samman Capital Probe Delay

The Supreme Court has criticized the CBI and Delhi Police for delays in the investigation into alleged fund diversion at Samman Capital, formerly Indiabulls Housing Finance. The court has granted a four-week window for agencies to submit a status report regarding the probe into alleged fraudulent loans to shell entities. Investors are tracking the legal developments as regulatory and investigative scrutiny remains ongoing.

The Supreme Court expressed strong dissatisfaction on Tuesday regarding the slow progress of the investigation into allegations of fund diversion and round-tripping involving Samman Capital Limited, which was formerly known as Indiabulls Housing Finance Limited. A bench led by Chief Justice Surya Kant questioned the Central Bureau of Investigation and the Economic Offences Wing of the Delhi Police over their failure to provide an updated status report on the ongoing probe.

Legal Proceedings and Agency Accountability

During the hearing, the court initially directed the heads of both the CBI and the Delhi Police’s Economic Offences Wing to appear in person to explain the delays. This directive was later withdrawn after Additional Solicitor General S.V. Raju assured the court that a comprehensive status report would be filed by the agencies. The court has adjourned the matter for four weeks to allow for this submission.

Nature of Allegations and Regulatory Context

This legal challenge stems from a petition filed by the Citizens Whistleblowers Forum. The allegations involve claims that the company previously extended large loans to various shell entities, which were subsequently funneled back to firms linked to the promoters. Beyond the CBI and the Economic Offences Wing, the Enforcement Directorate and the Ministry of Corporate Affairs have also been asked to present their responses regarding these financial allegations. The case has faced complex scrutiny over several years, with reports indicating that founder Sameer Gehlaut has been based abroad, leading to challenges in the investigative process.

Investor Considerations and Next Steps

For investors and stakeholders, the core concern remains the potential impact of long-standing governance and regulatory scrutiny on the company’s business operations. As Samman Capital continues its transition and attempts to realign its business model, the outcome of these investigative reports and the subsequent court observations are important factors for the company’s corporate image and regulatory compliance profile. The next critical update will be the submission of the status report by the investigative agencies following the four-week adjournment, which may provide more clarity on the future trajectory of the probe.
