TRAI's Framework for Export-Focused IoT Devices

The Telecom Regulatory Authority of India (TRAI) has unveiled a significant set of recommendations aimed at streamlining the use of foreign SIM and eSIM cards within Internet of Things (IoT) devices that are specifically manufactured for export. This initiative, driven by a request from the Department of Telecommunications (DoT), seeks to address a notable regulatory gap in the rapidly expanding machine-to-machine (M2M) and IoT sectors.

Addressing the Export Challenge

Indian manufacturers of sophisticated IoT-enabled equipment, ranging from smart meters and connected vehicles to industrial sensors, frequently encounter a critical connectivity hurdle. To ensure seamless operation and data transfer in their target international markets, these devices often require the integration of foreign SIM cards. Historically, the absence of a clear, supportive regulatory framework for procuring and using these foreign SIMs for export-bound devices created complexities and potential compliance issues for Indian businesses looking to expand globally.

A Light-Touch Authorization Regime

To bridge this gap, TRAI has proposed the introduction of a novel regulatory category: the "International M2M SIM Service Authorisation." This framework, designed under the principles of the Telecommunications Act, 2023, adopts a light-touch approach to authorization. The entire application and approval process is envisioned to be fully online, with digitally signed, auto-generated authorizations, significantly reducing administrative burdens.

The proposed scheme aims to be highly accessible for Indian companies. Any entity registered under the Indian Companies Act will be eligible to apply. Crucially, TRAI has recommended zero entry fees and zero authorization fees. There will be no minimum equity, net worth, or bank guarantee requirements, removing substantial financial barriers for businesses. The only cost involved will be a modest processing fee of ₹5,000. Furthermore, the authorization will have a substantial validity period of 10 years, providing long-term certainty for manufacturers.

Facilitating Testing and Quality Assurance

Recognizing the practical needs of product development and quality assurance, TRAI has also made provisions for temporary use. Foreign SIM and eSIM cards will be permitted to remain active within India for testing purposes for a duration of up to six months. This flexibility allows manufacturers to thoroughly test device functionality and connectivity within the country before deployment in export markets, ensuring higher quality and reliability of Indian-made IoT products.

Boosting 'Make in India' and Global Competitiveness

TRAI emphasizes that these recommendations are strategically aligned with the government's flagship 'Make in India' initiative. By facilitating the export of advanced IoT and M2M products, the proposed framework is expected to bolster domestic manufacturing capabilities and enhance the international competitiveness of Indian companies. The regulator advised the Department of Telecommunications to coordinate with other relevant central ministries, including the Ministries of Finance and Commerce, to establish a harmonized approach that covers both the import of foreign SIMs for export-oriented devices and the potential export of Indian SIMs for devices destined for foreign markets.
