Delta Corp GST Demand Reduced by Rs 8.12 Crore After Tax Authority Correction

Delta Corp’s total differential GST demand has been reduced to Rs 28.99 crore from Rs 37.11 crore.
The tax authority acknowledged a computation error, lowering the aggregate liability by Rs 8.12 crore.

Reader Takeaway: Tax authority correction provides minor liability relief, but the company remains liable for Rs 28.99 crore.

What just happened

Delta Corp Limited and its subsidiaries, Highstreet Cruises & Entertainment (HCEPL) and Delta Pleasure Cruise (DPCCPL), received rectification orders from the Additional Commissioner of Central GST, Goa. The authority revised the original September 2026 demand related to casino-entry packages, acknowledging that tax should have been calculated on a cum-tax basis rather than an ex-tax basis. This recalculation resulted in an aggregate reduction of Rs 8.12 crore across the group.

Why this matters

For investors, the adjustment slightly lowers the contingent tax liability on the company’s books. The demand specifically covers the period from July 2017 to March 2022. By shifting to a cum-tax calculation, the authorities have effectively acknowledged a significant overestimation in the initial demand notice.

Risks to watch

Despite the downward revision, the core tax demand persists. The company noted that all other findings from the original September 2026 orders remain unchanged. Penalties under Section 74 of the CGST Act have been adjusted in proportion to the new liability, but the company still faces a significant total payout requirement of Rs 28.99 crore. Management is currently evaluating the orders and is considering filing formal appeals against the remaining demands.

What to track next

Investors should monitor whether Delta Corp chooses to challenge the rectified order in higher appellate forums. The timeline for filing these appeals will be the next critical milestone in resolving this tax dispute.
